ColdNavigator is operated by a Turkey-based legal entity, with business operations and presence in Türkiye and the United Kingdom.

By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use the Service.

a. Subscription Plans

Access to the Service requires a paid subscription according to the pricing plans displayed on our website.

b. Payments

Payments are processed through our third-party payment provider Creem.io and are collected on behalf of our Turkey-based operating entity.

ColdNavigator does not store or process payment card information directly.

By using the Service, you agree to Creem.io’s applicable terms, conditions, and policies.

c. Billing & Cancellation

Subscriptions are billed on a recurring basis unless cancelled.

You may cancel your subscription at any time.
Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time unless explicitly stated.

d. Taxes

You are responsible for all applicable taxes, including VAT or similar charges, unless otherwise stated.

6. License and Permitted Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes.

You may not:

• Reverse engineer, decompile, or attempt to extract source code

• Use the Service for unlawful, harmful, or abusive activities

• Interfere with the integrity or performance of the Service

7. User Content

You retain ownership of any data or content you submit through the Service (“User Content”).

You grant us a worldwide, royalty-free license to use, store, process, and display User Content solely for the purpose of providing and improving the Service.

You represent that you have all necessary rights to the User Content you submit.

8. Data Protection and Privacy

Use of the Service is subject to our Privacy Policy.

9. Third-Party Platforms and Automation

ColdNavigator is an independent platform and is not affiliated with, endorsed by, or sponsored by LinkedIn or any other third-party platform.

You acknowledge and agree that:

• You are solely responsible for ensuring your use of the Service complies with third-party platform terms

• We do not guarantee that use of the Service will not result in account restrictions, suspensions, or bans

10. Intellectual Property Rights

All intellectual property rights in and to the Service, including software, trademarks, and documentation, are owned by ColdNavigator or its licensors.

You may not copy, modify, distribute, or create derivative works without our prior written consent.

11. Confidentiality

You agree not to disclose any non-public or confidential information obtained through the Service without our prior written consent.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLDNAVIGATOR SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES

• LOSS OF PROFITS, DATA, OR BUSINESS

• ACTIONS TAKEN BY THIRD-PARTY PLATFORMS

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless ColdNavigator, its affiliates, and representatives from any claims, damages, or expenses arising out of:

• Your use of the Service

• Your violation of these Terms

• Your violation of third-party platform terms

15. Termination

We may suspend or terminate your access to the Service at any time for:

• Violation of these Terms

• Fraudulent, abusive, or unlawful activity

• Legal or regulatory requirements

Termination does not relieve you of payment obligations incurred prior to termination.

16. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Türkiye.

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of İstanbul, Türkiye.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms constitute the entire agreement between you and ColdNavigator regarding the Service and supersede all prior agreements.
